The widespread recent memes surrounding Corona beer is not new to us. Reports suggest that Coronavirus has not just impacted global sectors of the economy but lately the fear has been so intense that it has created paranoia among the global citizens.

Lately, evidence pertaining to the association of Corona beer with Coronavirus have been found in Google searches. Further, as per YouGov Plc data, the ‘purchase intent’ of Corona beer has evidently declined in the past two years. This is a strong inference of the kind of panic and ignorance that is prevailing amidst the global citizens.

What is to be done next?                        

Sure it is no lie that Coronavirus has not just been affecting lives but it has also been responsible for the slowdown of the global markets. As per statistics, in the past two months, the overall Coronavirus toll in China increased to 2,744 with 78,497 confirmed cases. Nevertheless, it’s high time to keep the virus out of any such myths like that of Corona beer. This will not only create panic but also spread irrational fear among the citizens which will only make the situation worse.  

Effect on the beer industry

The slowdown of the global sectors is something that is not unknown to us. However, it is important to note that ever since the outbreak of Coronavirus, there has been a steep fall in the demand for beer. Local bars primarily in the US and China have seen a decline in people’s desire to visit bars. Production facilities are closed or barely operational, bars are shuttered and restaurants are operating on limited hours, leaving the stock untouched on shelves or in warehouses.

It is high time for the brands to look for cost initiatives to offset blows. But first, efforts should be made to clear out the rising misconception surrounding the virus.

The National Company Law Appellate Tribunal on Friday upheld the Rs 873-crore penalty imposed by fair trade regulator CCI on UBL and other beer makers.

The appellants "had already conceded in the leniency application to their role in the cartelization," a two-member panel stated after reviewing the papers and taking the arguments into account.

The NCLAT stated in reference to the group of petitions submitted to the CCI by the beer manufacturers asking for a decrease in penalty: "A lesser penalty application is like an admission of guilt in a cartel."

The two-member bench, made up of Justices Rakesh Kumar and Ashok Kumar Mishra, stated that once they had acknowledged their involvement in an application filed under Section 46 read with Regulation 5, they were only permitted to contest the imposition of a penalty.

On September 24, 2021, the Competition Commission of India fined UBL, Carlsberg India, the All India Brewers' Association, and 11 people a combined sum of about Rs 873 crore for cartelization in the sale and supply of beer.

The aforementioned order was contested in front of the NCLAT, which has appellate jurisdiction over the CCI with regard to any directives issued, judgements rendered, or orders passed by the regulator. The NCLAT also rejected the beer manufacturers' arguments that a CCI order can be overturned without a judicial member present and simply needs to be noted for its rejection.

NCLAT, however, rejected it and noted "Nowhere does it state that CCI must include a member of the judiciary. The addition of a judicial member to decide the process is not contemplated by the Competition Act."

Gopal Subramaniam, a senior attorney representing the beer company, said that the order building a prima facie case and initiating an investigation on the basis of a leniency application was invalid. The CCI had rejected their requests for leniency.

Regarding the severity of the penalty, NCLAT stated that it is clear that, despite the CCI's discretion to impose a fine up to 10% of the average turnover for the previous three fiscal years, in the present case, in addition to granting the benefit of the doubt on the leniency application, the CCI has also adopted a lenient stance. The amount of the fine was calculated as follows: 0.5 times profit for each year the cartel persisted, or 2% of total revenue for each year the cartel persisted, whichever was higher.

With Carlsberg India joining in from 2012 and AIBA acting as a forum for supporting such cartelization from 2013, the era of cartelization was deemed to span from 2009 to at least October 10, 2018. Before the regulator, all three beer businesses submitted applications for reduced penalties.

As per reports, Heineken-controlled UB had reported a net profit decline of 2.56% at Rs 106.37 crore for the third quarter that ended in December, while net sales was impacted by economic slowdown and new excise policy in Andhra Pradesh. In India, the alcoholic-beverage industry, including beer, is heavily regulated, with excise and other taxes forming an important source of revenue for state governments. Due to this, it is difficult for most companies and retailers to register higher profits.

The beer attracts the highest taxation of any beverage in the country, with only 5% alcohol in beer on average. Furthermore, beer retails from as low as Rs 36 for a Kingfisher beer bottle in Goa to Rs 115 in Madhya Pradesh, indicating how there is a huge price disparity for the same brand.

“With equity infusion of just Rs 84 crore till now, we have done gross revenue of over Rs 500 crore since we started. The burn has come down significantly and the leverage is kicking in,” Singh stated.

Dutch beermaker Heineken has decided to invest $3.1 billion to earn stake in China's top brewer, marking its entry in Asian giant's booming and hotly contested market, the two groups announced Friday.

Heineken has signed a "non-binding" agreement with China Resources Beer to acquire 40 percent of CRH, the listed entity controlling the Chinese group, for a total of 24.35 billion Hong Kong dollars, according to a statement.

In return, China Resources Beer will buy a 0.9 percent stake in Heineken for 464 million euros ($537 million).

The Dutch firm, which operates three breweries in the country, will merge its operations in China with those of its new partner.

Heineken will also grant its partner permission to market its eponymous beer brand in the country.

The deal allows Beijing-based China Resources Beer, known above all for low-cost brands like Snow Beer, to add a well-known premium brand to its line-up.

The merger of Heineken and its Chinese partner signals the growing competition in the Chinese market, with consumers turning towards foreign beers and better quality products as middle class incomes rise.

China market which is dominated by local brewers has three Chinese groups controlling more than 40 percent of the market, according to figures from Euromonitor International cited by Bloomberg News.

China Resources recently controlled 18 percent of the country's beer sales, followed by number two competitor Tsingtao.

The inclusion of Denmark's Carlsberg and Belgium's AB Inbev are putting pressure on prices and lowering margins, intensifying the rivalries between international giants. The pressure has prompted certain foreign groups to withdraw, including Japan's Asahi.

China, the world's largest market for beer production, "is forecast to be the biggest contributor to premium volume growth in the next five years, driven by its rapidly growing middle class," Heineken said in its release.

CEO Jean-Francois van Boxmeer praised the "winning combination" of Heineken's "strong brand" and China Resources Beer's extensive distribution network in the country.

After the Supreme Court’s mid-December judgement, several companies chose channel de-stocking as there wasn’t enough clarity on the implementation, which in turn hurt their January-March sales even as nearly 30,000 shops were shut in April.

Danish brewer Carlsberg’s India business dragged down volume growth in Asia region. But for India volume, the region would have grown 2%, the company said.

Cees't Hart, CEO, Carlsberg, said, "The totality of Asia (business) has, let’s say, declined or contracted a bit because of India. So, despite a good start in all the other countries, in India, because of the implication of the highway ban, we had a negative double-digit volume decline. So, it’s mainly India which impacts the performance in Asia in Q1."

The maker of eponymous lager and Tuborg saw Indian volume decline almost 20%, a steep fall from about 15-20% growth it has been posting for nearly a decade.

The world’s third largest brewer said it expects a volatile year in India with a hit in the first half of the calendar year in India due to the combination of closing, relocating and de-stocking.

Hart added, "What we see is a lot of creativity in India on how to mitigate this for, first of all, the states and secondly for local entrepreneurs. We don’t see a lower demand."

Michael Jensen, CEO, Carlsberg India, said, "It is very detrimental for investor confidence."

India’s beer sales fell 2% in the year to March 2017. Yet, the industry expects to grow 5-7% during the fiscal on the back of new launches.

Anand Kripalu, CEO, United Spirits, said, "We expect the impact to be mitigated eventually and where it doesn’t, consumption will shift to other outlets."
