Restaurant India News: Devans Modern Breweries Files Trademark Case Against Cartel Bros in Delhi High Court

Devans Modern Breweries Limited has initiated legal proceedings before the Delhi High Court in a trademark infringement dispute against Cartel Bros, an entity associated with Sanjay Dutt.

According to submissions made before the court, Devans has alleged that Cartel Bros adopted the “GODFATHER” mark in a manner that is identical to its registered trademark used for its flagship beer brand. The company stated that the “GODFATHER” trademark has established significant market recognition and goodwill in India, supported by multiple registrations. It further argued that the use of the same mark for a whisky product could result in trademark infringement and passing off within the alcoholic beverages segment.

Following arguments presented during the hearing, the Defendants agreed to hold back the commercial rollout of their product under the disputed mark until the next scheduled hearing. This interim arrangement indicates a pause in market entry for the product amid ongoing legal scrutiny.

The court has also issued directions restricting the Defendants from releasing any new promotional or social media communications related to the product under the “GODFATHER” branding during this period.

The case highlights increasing competition and brand sensitivity within India’s alcohol sector, where trademark ownership and brand recall play a critical role in market positioning. The outcome of the matter is expected to have implications for branding strategies, particularly in categories where legacy labels hold established consumer recognition.
